A Section 219 Covenant is a charge secured against the title to a property in favour of the municipality to impose a positive or negative obligation on the property owner, as per the provisions of Section 219 of the Land Title Act. The City may enter into a Section 219 Covenant with a property owner to regulate the use of land or the construction of structures or buildings, associated with a development approval process.
Where a Section 219 Covenant has been secured against the title of a property through a public process, such as a zoning bylaw amendment. A public process will be required to amend or discharge the Section 219 Covenant.
